Section 302 (b) Constitution of Pakistan (1973), Article 185 (3) appealed against the illegal delay in filing an FIR in the absence of a proper explanation, the prosecution's witnesses, both defendants. The accused had suggested his absence in the presence of his father at the relevant time to kill his father in his presence, before the dispute over the property had led to the enmity between the parties. There was no crime left by chance, there was no corruption of the gun recovery justice which led to the decision of the High Court accused. The heart was not damaged, nor was the reason shown was artificial or insidious and therefore did not face any form of irregularities or instability, to guarantee the intervention of the Supreme Court. Accordingly, the complainant was denied leave to appeal
