Article 148 Constitution of Pakistan (1973) Retaining the Constitution Petition Real Estate Mortgage The complex question of fact is that the applicant's complaint was that it was the property of his predecessor in the interests of which he had already divided. Was released and the authorities mistakenly allotted it to the respondents, the land is legitimate as a vacant property. Neither the applicants knew the mortgage history of the mortgage nor attached any document in favor of the mortgage or mutation or mortgage the occupation of this land was also disputed as both parties claim. They were in control. The same important question also arose in this petition as the period of 60 years was provided under the law for redemption of mortgaged land and, according to the petition and constitution for the year, 1908 09, suit land was granted to the mortgagee. As has been shown, such complex questions can be resolved only after the civil court can declare the title of evidence and the High Court has exercised constitutional jurisdiction over the possession of the parties.
