Criminal Revision No. 1052 of 1976, decided on 26th November 1976.

Criminal Procedure Code (V of 1898)‑

‑‑ S. 497(1), Proviso‑Final order after interim bail of petitioner with held by Session Court on police request for some more time to ascertain authenticity of disputed document through Expert‑‑ Case of petitioner, held, covered under Proviso to subsection (1) of S. 497 in circumstance‑Court directed to finally dispose of petition.

ORDER

The petitioner moved petition for bail before arrest. She was allowed interim bail. The learned Additional Sessions Judge passed an order on 12‑11‑1976, that during the course of arguments, the A. S. I. stated that lie wanted more time to ascertain the authenticity of the document. The bail petition was adjourned to 16‑11‑1976. It was again adjourned to 28th of November 1976, on the ground that the specimen signatures had to be sent to the expert for comparison. It is a petition, which could be disposed of even without the final result of the expert. The offences do not fall within the prohibitory clause, and besides, the case of the petitioner is, covered under proviso to subsection (1) of section 497, Cr. P. C. This petition is disposed of with a direction to the learned Additional Sessions Judge to finally dispose of the petition on 28th November 1976.
