GULZAR AHMAD versus ACCOUNTS OFFICER, SETTLEMENT OFFICE, BAHAWALPUR ETC.

Section 2 (b) and 4 departments of the Punjab Administration (Service) Tribunals Act 1974 were dismissed before the Department of Settlement Department was transferred from the Central Government to the Provincial Government, never in the service of the Punjab Government. 2 (b) does not mean a civil servant. Therefore, the tribunal is not entitled to appeal

GULZAR AHMAD

Versus

ACCOUNTS OFFICER, SETTLEMENT OFFICE, BAHAWALPUR ETC.

Case No. 427 of 1974, decided on 4th November 1974.

Punjab Administrative Tribunals Act (IX of 1974)‑

‑‑ Ss. 2(b) & 4‑Employee of Settlement Department dismissed prior to transfer of Settlement Deptt. from Central Government to Provincial Government‑Never in service of Punjab Government‑Not a "Civil Servant" within meaning of S. 2(b) hence not entitled to appeal before Tribunal.

ORDER

The appellant was an employee of the Settlement Department. By an order dated 3‑9‑68 he was dismissed from service by the Dy. Settlement Commissioner, in whose office he was posted as Daftri. He preferred an appeal against his dismissal which was rejected by the Add]. Settlement Commissioner on 12‑6‑69. His request for re‑instatement was turned down by the office of the Chief Settlement Commissioner on 10‑9‑70. He has now come to this Tribunal.

This appeal is misconceived for the reason that at the time when the appellant was dismissed from service the Settlement Department was a part of the Central Government. Thus 'he has never been in the service of the Provincial Government. Consequently, he is not a civil servant within the meaning of clause (b) of section 2 of the Punjab Administrative Tribunals Act so as to have the right to approach this Tribunal. This appeal is accordingly dismissed in limine.
