Section 45B appeals taxpayers claim that the first appellate authority was in error of law and despite the fact that the action was initially initiated by him while he was posted as Additional Collector Judiciary and the first appellant. The order passed by the authority was rejected. After the score was taken in only one place, the legal appellate authority was not within their jurisdiction, in which they had a key role in initiating proceedings by issuing show cause notices. The first appellate authority had made up its mind when issuing the showcase notice and the fact of prejudice that was so prevalent could not be ruled out. The courts had to assure the reasonableness of honesty and impartiality, which was also extinct in the case in which justice should not only be done but should have been accepted. And the appellate tribunal, along with the orders, actually fixed the order as the appeal was decided on a legal basis and the basis that was taken by the appellant was not removed.
