K.M.C. OFFICERS' CO-OPERATIVE HOUSING SOCIETY LTD. versus SHEHRI
Sections 42 and 54 Civil Procedure Code (v. 1908), Sections 151 and OXIV, R5 Suite have filed an application under OXIV, R5, CPC for the declaration and injunction already listing the cases To create additional issues. The framework was mandated by the High Court in that the defendants filed a petition on the basis that the matter presented by one of the defendants was presented under the other issues presented by the High Court. Two suits were upheld by the High Court after which the court revealed from the stable cases record that one of the cases was thereafter that the trial was then dismissed under O VII, R 11, CPC. However, in the case of the said application, it should be included whether the plaintiff in another case is bound to be denied under O. VIII, R11, CPC High Court accepted the application in the circumstances and said that the issue / framing of the case as well as other matters prepared by it were allowed.
