R. O. R. No. 51 of 1950‑51, decided on 11th December, 1952.
Ss. 4 and 5‑Ss. 44 and 45, Punjab Tenancy Act (XVI of 1887), made ineffective, only in respect of notices issued on or after 15th June, 1949‑Order in P L D (Rev.) 1952 Pb. 17 amended on Review.
Petitioner absent.
Respondent with counsel.
‑Parties were given notice as I wanted to review my order dated 4th March 1952, in order to remove the ambiguity appearing in the concluding sentence of the last but one Para of my order dated 4th March 1952, which reads as under:‑
"Under section 4 of the Punjab Protection and Restora tion of Tenancy Rights Act, sections 44 and 45 of the Punjab Tenancy Act have been made ineffective, and therefore section 77 of the latter Act is the only section under which a landlord could enforce his rights".
According to section 4 of the Punjab Protection and Restoration of Tenancy Rights Act, sections 44 and 45 of the Punjab Tenancy Act have been made ineffective in respect of the notices issued against the tenants on or after the 15th June 1949. In order to bring my order in consonance with the above mentioned provisions of law, the last sentence of the last but one Para of my order dated 4th March 1952, quoted above should be considered to have been deleted.
Announced.
A. H. Para. deleted from order.
