The verdict was not challenged by the deceased's legal heirs, and the trial was filed in the trial court. The trial court was reluctant to accept the plea on the basis that under section 338E, the PPC provisions had to be filed before the High Court's endorsement, when no appeal was pending in any court. Was able to decide all questions. As the petitioner's appeal was decided by a division bench of the High Court and no appeal was filed by the applicant. The e-trial court was able to decide the questions related to the waiver and the trial court was ordered to adjourn the pending petitions within two weeks, in the circumstances.
