Under the section 5 and the Schedule Constitution of Pakistan, the father (applicant) of the Article 199 constitutional petition, minors were allowed to live with his mother under which the minor was detained. The father confessed that the mother had suffered from an infectious disease. The question of the welfare of the minor cannot be interfered with in the search of the courts below. In the constitutional jurisdiction of the High Court, the minor was approximately four years of age. Therefore, the mother was detained as a matter under Islamic law.
