Article 11 Constitution of Pakistan (1973), Article 185 (3) of the Res Judesta Petitioner held that the High Courts as well as the lower courts were caught in the error of misrepresentation and non-reading of evidence. The owner of the suit land as joint shareholder in the joint suit and thus his case should have been dismissed. The petitioner also asserted that the order passed by the Revenue Authorities under Section 11 would not work as a judiciary, but satisfied that the CPC was allowed to consider the leave of appeal.
