MALAK JEHANGIR KHAN AND OTHERS versus SARDAR ALI
In the appeal against section 302 (b) and 201 constitution of Pakistan (1973), Article 185 (3), the judicial confession was withdrawn only from the piece of evidence against the accused which, according to the High Court, also from any other independent evidence. Was not proved, nor was it denied. Evidence of illegal, inaccurate reading or evidence of bail for interference by the Supreme Court may be indicated. The verdict of acquittal of the accused was properly passed after the scrutiny of all the evidence collected by the prosecution.
