BRANCH MANAGER, MESSRS UNITED REFRIGERATION INDUSTRIES (PVT.) LTD. versus STATE
Section 526 Criminal Procedure (XLV of 1860), Section 489F Constitution of Pakistan (1973), Article 185 (3) Transferring criminal cases closed together in criminal and civil litigation, the respondent against the applicant. The suit was filed and the petitioner filed a criminal case against the plaintiff under Section 948FF. The PPC civil suit was filed by the plaintiff which was filed by the High Court. The petitioner had requested that his criminal case against the defendant be transferred as well, but, the Supreme Court dismissed the petition. The refusal to do so through the Nazi verdict is justified. It was appropriate and in the interest of justice, if civil and criminal cases are heard at the same station since the case filed by the defendant has already moved \ P place. Was gone, so there would be no injustice. Due to the respondents, if the petitioner's case should also be moved from place to place, the application was changed to appeal and the decision was declared invalid and the matter was transferred.
