FAQIR BAKHSH versus JINDWADDA
A. XXIII, RI Specific Relief Act (I of 1877), was filed for retracting a case for filing a Section 42 lawsuit, before it was filed by the plaintiffs and they were brought before the trial. A fresh case was filed during the trial. O XXIII, the defendants were prevented from filing a fresh case in view of the bar contained in R 1, the defendants' CPC claim was that the latest case filed by them was OXXII, R 1, CPC. The same suit was also filed during the parties before the same suit which was withdrawn after the establishment of the fresh suit, where the fresh suit had already been established and the earlier suit. Was pending at the time of his return, there was no fresh suit killed in the C nor was it stopped by the courts of XXIII, R1, CPC, deciding the case against the defendants. No such illegal or irregularities were committed
