Section 191919 Criminal Code of Conduct (v. 1898), Sections 439A, 439 (5) and 417 (2A) of the Constitution of Pakistan (1973), Article 199 Constitution, Section 249, on the charge of acquittal by a Magistrate. A review petition against the accusation of retention was available to the complainant under Section 417 (2A) of the PC for filing an appeal, against the aforesaid injunction against the Cession Court. The RPC review request, therefore, was not a separate order passed in the session court's review. Magistrate declared illegal and illegal as a result of obtaining a case remand for fresh merit decision
