NATIONAL INSURANCE COMPANY LIMITED versus MUHAMMAD SADIQ AND ANOTHER
Re-ordered in post-remand proceedings following the declaration of Article 42 Civil Code of Conduct (v. 1908), Articles 51, 151 and OXXI, Articles 32, 37, 43 and 54 of the Constitution of Pakistan (1973), Article 199 Constitution Petition. And accordingly the order was withdrawn in favor of the plaintiff and the decision was successfully challenged before the appellate court, the revision court and finally the Supreme Court and such order was passed before the Supreme Court. Authentication could not be re-examined for punishment. At the stage of the petition in the constitutional petition, it was claimed that according to the claims in the plaintiff's case, the plaintiff's case was fully decided that there was ambiguity in the decree, that such confusion / doubt should be given to the defendant. Mentioning the words as a prayer in a non-judgmental decision in the circumstances, would not indicate that it was partially decided.
