The action should have been taken against which the department was prosecuted and eventually it dismissed the employees related to the criminal, the proceedings and the departmental proceedings were completely different, one related to the offender. While the implementation of the responsibility belonged to the discipline of service and disciplinary action had no effect on the criminal proceedings, such contempt was not a matter of law. The suit against the defendants was dismissed accordingly
