MUHAMMAD BAKHSH AND OTHERS versus MST. ZOHRAN SARWAR AND OTHERS
Section 12 and 42 of the Constitution of Pakistan (1973), Article 185 (3), declare under the plaintiff the final result of the facts claimed by the courts that he is the owner of the suit land and, alternatively, the trial court. Claims specific performance of the sale agreement was retained by the appellate court and the High Court filed in favor of the plaintiff and the decision and order as well as the simultaneous discovery of the facts available on record by the three courts. All such courts had considered all the material evidence and were present in the judgment passed by the High Court. I was reading the wrong material or wrong structure of the non-reading based on appropriate definition of the facts and the law and refused permission to appeal was not open to exception
