MUHAMMAD SIDDIQUE versus MUHAMMAD GHAFOOR
Sections 302 and 109 of the West Pakistan Arms Ordinance (XX 1965), Section 13 Criminal Code of Conduct (V9 1898), Section 249A & 345 of the Azad Jammu and Kashmir Interim Authorization Act (VIII 1974), Section 42 of the main accused on the definition of evidence. After the settlement between the complainant and the central accused on the basis of the waiver agreement, the main accused was acquitted after payment of the dues to the legal offspring of the accused, followed by section 249A, CRPC. The petition was heard after the trial. The accused were acquitted, there was no justification for their trial, the trial court granted the petition and ordered the acquittal of the accused.
