ABDUL HAQ versus MUHAMMAD AMIN ALIAS MANNA
Sections 302/452 Criminal Code of Conduct (v. 1898), Sections 403 of Pakistan (1973), Arts 13 and 185 (3) were commuted to life imprisonment after the High Court passed the sentence. He was released from custody. Now the accused was subjected to another sentence for the same offense, then it would be unfair, unfair and in violation of Article 13 of the Constitution which was read with Section 403, the CCPC court dismissed the petition and Holiday canceled.
