MST. KISHWAR BIBI versus MST. FAZAL BIBI
A. XLI, Rr. 16 and 30 of the Special Relief Act (I, 1877), on the occasion of hearing to the parties in section 42 appeal, the need for a suit to be filed by the plaintiff, in favor of the defendants on the basis of the gift. Declaring certain mutations as fraudulent documents were dismissed by the trial court's appeal by the defendants against dismissal, the defendants conceded that they were not given the opportunity to be heard by the appellate court. And the matter was resolved quickly. The appellate court had, through the appellate court, ruled that the content was illegal and irregular. This shows that the appellate court decided the appeal without qualifying the defendants, even though the defendants' written arguments were not on file.
