It happened because the parties are real brothers and they were jointly joint. In the possession of the property notice referred to under section 145 (1), the CCP was not issued within the next two months prior to the magistrate's date of disposal, under the circumstances, by order of the speech section. 145, the action initiated under the CR PC was rightly dismissed. The order passed by the sessions court in keeping with the magistrate's order was based on facts and proper definition of law, which according to him did not face any illegality or weakness.
