GHULAM ASGHAR KHAN versus BANK OF PUNJAB

Section 9 (5), 12 and 22 suits for recovery of tax filed by the plaintiff bank were filed by the Banking Court under section 12 of the Financial Affairs (Rehabilitation Rehabilitation) Ordinance 2001 against these defendants. The one that was excluded, which was to be filed within 10 days of the earlier judgment and order rejecting the order, was filed more than 2 months later. The defendants failed to explain the delay of each day. The records of the preceding partial judgment and injunction revealed that the services were effectively affected by the defendants who failed to disclose any good reason for the reversal of the previous judgment and injunction. There was no guarantee of any interference in the trial court's decision.
