Sections 2 (k), 8 and 25 of the Engineering Works Construction and Implementation by-Laws, 1987, by-laws 3 and 4 constitution of Pakistan (1973), Article 185 Council to make the appellant (contractor) enrolled in accordance with the provisions of the Act Required. And the appellant's view of its by-laws was that its registration was not required under the Act as it was not under the jurisdiction of the Council under section 8 of the Act. And that by-laws 3 and 4 are against the Act, because under section 25 the Council was not empowered to make such natural laws where the work of professional engineering was covered under section 2 (k) of the Act. Then its provisions would be attracted to the Act, but otherwise the Supreme Court dismissed the appeal.
