CITIBANK N.A. versus LT.-COL. ANWARUL HAQ
Financial Institutions (Recovery of Taxes) Ordinance 2001 suits for the collection of Articles 9, 10, 11 and 22 of the Banking Court of Rs 16,31,522, while the order passed for the receipt of the respondent's Rs 5,31,280. Depending on the bank, the bank said that the banking court should have approved the interim order in the case of such letter and the bank should have allowed it to prove its claim. The plaintiff's opinion was that the banking court erroneously dismissed his leave application and approved the order for such amount as only Rs. 99,500 was left. Against this, since both parties were not satisfied with the order, the High Court allowed their appeal, leaving aside the unclean order, resulting in a leave to defend the lawsuit filed by the defendant. The application for has been accepted and the case will be considered pending before the Banking Court, after deciding the matters and recording the evidence of the parties within a stipulated time.
