Regular acquisition of land by the Forest Department was not necessary to attract a prohibited order, on 27 March 1965 the Department occupied the forests, whether informed or under notified scheme, to exclude such land from allotment. Enough of the directive utility was already reviewed by the Supreme Court on 27-25 1965 and the intact notified officer acted within his legal jurisdiction to approve the illegal order; the High Court dismissed the constitutional application in the circumstances.
