An appeal has been filed under Section 17 (3) and Section 24 of the Constitution (XLV of 1860), Section 314/324/365/148/149 Constitution of Pakistan (1973), Section 203 DD. The Crimes Against Property (Enforcement Hood) Ordinance, 1979, was also framed under the aforementioned section and the accused was prosecuted for the said offense and the outcome of the trial could not change the jurisdiction of the court, as mentioned above. I appeal against the verdict of evil. The case against the Property falls under the purview of Article 24 of the Ordinance, 1979, which was read with Art 203 DD of the Constitution, and the Federal Law Shariat filed the same appeal before the High Court, Had the power to hear and decide. Not feasible and accordingly there were observations that the accused could approach the competent judicial court, if it is advised, who could consider the possibility of an appeal before it could sympathetically consider the limitation point.
