AZAD GOVERNMENT OF THE STATE OF JAMMU AND KASHMIR THROUGH CHIEF SECRETARY, MUZAFFARABAD versus MUMTAZ AHMED QURESHI
In the petition written in Section 11 Azad Jammu and Kashmir Roll of Business, 1985, R7 (c) and (d) Azad Jammu and Kashmir Interim Constitution Act (VIII of 1974), the High Court has made the respondent concerned about the construction of petrol pumps. Claimed that they did not receive any objection certificate from the concerned authorities for the construction of petrol pumps on their land. The respondent was instructed not to resume construction work under the orders of the Chief Secretary and the respondent and the Chief. A committee has been constituted to look into this committee on the representation of the secretary. Not only will this be dangerous to the area but also the master plan is violated and the security risk is also prohibited from increasing the construction of petrol pumps by a constitutional petition filed by the respondents against the prohibited order. It was accepted that the respondents did not obtain any objection certificates for this construction regarding the petrol pump on the site when no one had given any objection certificate to the respondents in the writ petition filed in the High Court but this Has never denied that he wants to build a petrol pump, but only through it It was decided to dig up the land and build something special that the High Court had approved, besides being outside the scope of pleading by the parties, which was the result of misrepresentation and misappropriation of the judicial mind. It cannot be declared a decision in the eyes of the law. Accepting the appeal put aside the High Court decision
