NATIONAL DEVELOPMENT FINANCE CORPORATION versus MESSRS MILLROCK QUARRING (PVT.) LTD
Banking Companies (Loans, Progress, Credit and Recovery of Financial Issues) Ordinance 1997 Sections 9 and 10 of the Contract Act (IX of 1872) Section 73 obtained the financial benefit of the plaintiffs' non-filing financial loss for recovery of bank loans. Despite the payment of the loan, the banking court did not appear for any of the defendants during the proceedings nor any petition for leave was sought for defense. The bank filed all necessary documents with the defendant. And claimed that any rejection of the legal damages by the High Court was the same as the documents and statements given in the case. Except in the dependent claims that damages suit was MC which was rejected by the judge.
