NAZIR MUHAMMAD versus COLLECTOR LAND ACQUISITION, HARIPUR
Section 23 Civil Procedure Code (v. 1908), AXXVI, R9 Compensation, determination of local commissions, deployment of local commissioner to ascertain the nature and market value of the land occupied by the appointment of matters in the determination of compensation. The effect of nothing was available on the record how the nature of the acquired land and the value of its market were ascertained. A local commission should not be appointed to ascertain the cost of the land when there is no barrier to the appointment of a local commissioner on receipt of evidence. The referee court did not comply with the law on the matter and the decision and decision of the referee court were rejected. Objection requests were remanded to the referee court for adjudication, and reasonable compensation for the location, nature and nature of the land acquired after the appointment of the local commission.
