JAN MUHAMMAD versus HAMIDA AKHTAR
Provisional injunction and interlocutory injunction of Civil Procedure Code Order XXXIX was approved by the interim injunction subpoena for the declaration of A-XXXIX, RI Special Relief Act (I of 1877), Section 42 of the Constitution of Pakistan (1973), Article 185 (3). The apex court has to consider the applicant's problems that the defendant alleged to own a particular plot in the disputed measles number, which was recorded as a joint property in the Revenue Record. It could not be proved that there was a private division between the shareholders and that the respondents were the sole proprietors of the underwriting plot, which was yet to be decided by the court while dealing with the merit case. And this order was temporarily passed for a restraining order and the whole matter that really affected the merits of this case was dealt with.
