MUHAMMAD MALIK versus RETURNING OFFICER
The Punjab Local Government Election Rules 2000 R47 Constitution of Pakistan (1973), Article 199 constitutional application on the record of wrong votes in the calculation of clear votes on record, the Returning Officer showed 499 votes while the retired candidate obtained the total. The polling station was voted 517, out of which 18 were found to be illegal, thus, the total valid votes were 499, which was obtained by various candidates, in which no notification of return was issued to the returning candidate. The dispute was that although the error was evident on the record, it was only after the results were announced that the returning officer made such corrections. The function had become opioid, the High Court had already withheld the declaration of results and if a notification was issued in this regard, it would be illegal, the High Court directed the Returning Officer to correct it. ? Issue the mistake and the correct result and then the latest notification should be issued by the Election Commission.
