Banking Companies (Loans, Progress, Credit and Financial Issues Recovery) Sections 10 and 21 of the Ordinance 1997 Defend the matter Serious and explicit dispute borrower imported goods due to the bank and retire to the importer. After failing to clear the goods, the bank was trapped on documents and payments, the borrower was exposed to the documents and in the present case, there was a dispute between the bank and the borrower and, therefore, a leave of defense. The banking court and the matter should have been given. The decision on the issue of eligibility and the decree passed by the Banking Court were set aside and the defense was granted leave accordingly the appeal was allowed.
