Sections 3, 9 (a) (iv) (v), 12, 13, 18 and 33 of the Civil Code of Conduct (v. 1908), Sections 9 and O. VII, R1 of the Special Relief Act (of 1877), constitution of S. 42 of Pakistan (1973), Article 185 alleges that he held property acquired by misusing his public office in the names of his dependents / relatives (appellants) because the properties standing in the names of the uninsured appellants. Was included in the charge and was frozen under national section 12. The Accountability Bureau Ordinance, 1999, dealing with the three real owners of the accused, filed a civil suit to claim that they were the real owners of the accused and not to dismiss cases on the accused defendant's allegations. OVII, R 11, filed an application under CPC. Under Section 13 of the National Accountability Bureau Ordinance Trial Court, the jurisdiction of the civil court was barred from proceeding with the case, but the appellate court accepted and rejected it. The issue of the allegations and the suit in question was the same, if there was a dispute between the original owner and the unusual owners, who were alleged to have caused the former to deny their rights. The same case would have been a civil-nature dispute only heard by a civil court under Article 9 of the CPC where a public office accused was obtained through illegal and corrupt practices by misusing governmental power in his name. Attempts were being made to collect the lost wealth. Spouses, relatives, disputes between the two private parties were of no nature, as there were four cases.
