RASHID MEHMOOD versus ADDITIONAL INSPECTOR-GENERAL OF POLICE
Punjab Service Tribunals Act 1974 Section 4 Government Employees (Talent and Discipline) Rules, 1973, RR 2 (1), 3 and 6 were dismissed from the Government Employee Employee on dismissal. Only on the charge of involvement in the criminal case did the service tribunal uphold the decision of the department authority and the appeal was dismissed. Regular inquiry was not made by the department authority, the applicant may plead that the criminal court has acquitted him. The authority was unable to terminate or remove him from the job where the department authority failed to conduct a regular investigation against a civil servant, so there was no basis for a public employee to be prosecuted, according to the service tribunal. The approved judicial decision was not set aside. And the Supreme Court directs the authorities to restore the public servant: to serve with Beacon for a period that he was not employed profitably, where an appeal was allowed
