FIDA HUSSAIN versus THE STATE
Criminal Code of Conduct (CRPC) Section 497 (1), Third Proviso Panel Code (XLV of 1860), Section 302/34/377 Offense Hood (Enforcement Hood) Ordinance (VII of 1979), Section 12 Constitution of Pakistan ( 1973), Article ? 3 185 (accused) suspended by the Supreme Court on the offer of the accused and the bail proceedings in the case of the accused for almost three years, the accused cannot be found guilty of delay. The proposed co-accused was in similar circumstances and on the same charge, the Supreme Court admitted bail and in view of the rule of stability, the accused was entitled to equal treatment before the law, for the third time under section 497. Was charged in the context of (1), the CRPC could not be detained indefinitely. The application for leave to appeal for the Court of Appeal Act was changed under the circumstances to appeal and by allowing the same accused to be admitted on bail.
