PRIVATIZATION COMMISSION OF PAKISTAN CONSTITUTION AVENUE, ISLAMABAD versus MESSRS PETROSIN PRODUCTS (PVT.) LIMITED
The provisions of Sections 15, 16, 17, 20 and 41 of the Arbitration Act, 1940, on the direction of the trial court on finalizing the rule of the court case, were the arbitration clause under dispute between the parties to the agreement. Demands were made to the sole arbitrator, with one excuse being delayed or the other trial court directed the arbitrator to review and finalize the dispute itself and award the arbitrator in compliance. The same was filed in the trial court which ruled the court. The award and objections were raised by the appellant as well as the rule of the court. The Civil Court was not a court of appeal against an arbitration award where there was no discrimination of any kind in the contents of such award and would be void. The arbitrator was charged with corruption, such an award was based on the correct assumptions of the law and the facts and did not warrant the devil's intervention.
