ILAM-UD-DIN versus SARFRAZ HUSSAIN
O XVIII, R18 Constitution of Pakistan (1973), Article 185 (3) Failure to file objection to local inspection notice was dismissed by the plaintiff, the Lower Appeal Court having personally disputed the contentious site. Upon inspection and allowed inspection note, the appeal was withheld before the High Court in reviewing the judgment of the lower appellate court and the same was dismissed, which validated the inspection note which led to the judgment of the court. And the basis for overturning the order was not challenged. At any stage, legally and realistically, the appellate and review forums had exercised the jurisdiction they had established, for any apparent reason on record that could warrant interference with the concurrence of the courts, The appeal was granted.
