Section 12 (2) Decree, aside from the dissolution process, the appeal before the High Court was decided on the basis of compromise. The matter was already settled on the payment of Rs 5,000 by the appellants in the lower appellate court. But due to some dispute, the matter did not go forward till the amount settled between the parties and the lower appellate court decided to appeal on its own merits. The fact is that the second appeal was decided on the basis of a compromise. So that the proceedings between the parties will not be collective. Under this section, application under section 12 (2) was dismissed.
