Appeals Judicial Magistrate against Section 249A & 417 Criminal Code (XL of 1860), Section 448 of the Criminal Procedure Code (XL of 1860) and 506 Offenses against Property (Ordinance Hood) Ordinance (VI of 1979), Section 14 Has done bad. On his request under Section 249 ACPC, the accused was acquitted without charge on the basis that the challan was submitted after a delay of more than seventeen days of FIR registration, under section 249A. The CRPC was not there before the accused was charged. The High Court, rejecting the appeal against the acquittal, granted the Judicial Magistrate's pre-requisite order passed on the accused's premature application.
