RAFI KASHIF versus IMTIAZ AHMAD
During the proceedings for the execution of Article 9, 10 and 11 Constitution of Pakistan (1973), Article 199 Constitution of the Oaths Act 1873, the petitioner resigned from the offer for a disputed factual decision on special oath. What was decided against the dispute. The petitioner's position was that the court decided the matter without recording the parties' statements. The right to withdraw from the offer was not granted under Sections 9, 10 and 11 of the Act, 1873, and the applicant will not be allowed to return. From its presentation / position, on a mere technical basis, no material misconduct or illegal conduct was committed by the court below, the constitutional application was dismissed under the circumstances.
