MANZOOR HUSSAIN versus ABDUL AZIZ
West Pakistan Citizens Rent Ordinance 1959 Section 2 (c) (i) Constitution of Pakistan (1973), Article 199 Constitutional application which denied the existence of a landlord and tenant relationship between the parties, proved the issue. It was their responsibility to do so. The tenants had to stand on their feet and remove the position of evidence placed on them, but they failed to do so, as the lower courts simultaneously found that the tenants had no evidence of the evidence placed on them. Failed to charge for the reason. The record-based exercise of its constitutional jurisdiction cannot be interfered with by the High Court.
