Section 497 (5) of the Criminal Procedure (XLV of 1860), Section 302/34 bail, found guilty during the trial of the accused, the trial court granted bail on the basis that two investigating officers; one deputy superintendent police and the other. The Superintendent of Police, felt that the two accused were not present at the time of the incident and had not participated in it, thus, the trial court had used innocent evidence to release both the accused. The people on bail were not arbitrary or unreasonable or the aforementioned bail was not allowed to the accused.
