FATEH DIN versus MUHAMMAD BOOTA
Section 42 of the Azad Jammu and Kashmir Interim Constitution Drafting Act, 1974, was delayed by seven days for appeal to the Supreme Court. Appellant had requested that he not be able to file an appeal within time because of his sudden illness, and the doctor suggested resting on the bed for 15 years. The appellant's delayed affidavit and medical certificate were silent on the silent cuff that when the applicant became ill, there was no date on the medical certificate as well as the medical certificate signed by the appellant. An affidavit filed by noncompliance was also filed. Sub-dependency, appeal for delay in filing an appeal was rejected and the appeal which was rejected was withheld from time to time
