WALIDAD versus SHAH DIN
Colonization of Government Land (Punjab) Act 1912 Section 24 Cancellation of allotment of land without notice The Collector, on the basis of only one report, canceled the land allotted to the plaintiff in which both the courts formally opposed such cancellation. The judgment in the case was heard. The reason for the defendant not giving any notice before the proceedings against him was that the defendant's position was that under the provisions of Section 24, Government Lands Colonization (Punjab) Act 1912, if the allotment violated the terms of the allotment. No notice is required. Accuracy Where no notice was given by the collector prior to the cancellation or reinstatement of the suit land from the plaintiff, such an action required notice under the law, justifying the decisions and orders of both the courts.
