Special Court in view of section 30 (3) of the Anti-Terrorism Act (XLV of 1860), Section 365 A / 342/109/34 of the Anti-Terrorism Act (XXVII of 1997), Section 30 (3) Cannot approve bail except. The powers of the High Court in regard to the approval of the bail by the Legislature of Terrorism Act, 1997, were not able to grant bail in a pending trial in the special court established under the High Court Anti-Terrorism Act 1997. The constitution had to be followed by the law and any departure from it would be unnecessary in the eyes of the law, therefore, it was not enforceable in the High Court and accordingly it was excluded.
