GHULAM SAKEENA versus BASHIR AHMAD
The trial court accepted the petition filed under section 12 (2) of the Appellate Tribunal in review of Articles 12 (2), 96 and 115 of the Constitution of Pakistan 1908 (1973), Article 199 Constitution, CP C reversed the decision passed by it, and petitioner, upset by the trial court's order, filed an appeal before the appellate court, following which the appellate court disqualified him. Denied, on the application under Section 12 (2), CPC, there was no right of appeal and this court had no jurisdiction. Change Appeal In Review The legal appellate court had the power to modify the appeal before being satisfied and after it was satisfied that the competent case should be decided that it was satisfied that no other law had been affected. The appellate court's decision was put down and remanded, the case should be decided on merit.
