IMTIAZ HUSSAIN versus STATE
Pakistan Penal Code Section 420 Constitution of Pakistan (1973), Article 199 Constitutional petition was filed on the basis of a written agreement between the parties against the FIR applicants concerning the civil suit against the FIR criminal prosecution. The first civil suit was pending in the civil court. A constitutional petition was filed in the High Court for the registration of the FIR, in which the station house officer of the police station banned harassing the applicant. The FIR merely harassed the applicant and the complainant's wishes. There was a clear cut device to meet and to insult the applicant. Further criminal action, based on the FIR, would result in misuse of the law, FIR was ordered to end the situation.
