MUHAMMAD TUFAIL versus STATE
The Pakistan Penal Code Section 409/420/468/471/218/109 Constitution of Pakistan (1973), Article 185 (3) argued that the accused Zakat, and being a member of the Usher Committee, was a civil servant on the basis of the provisions of this section. The Zakat and Usher Ordinance, 23 of 1980 and, therefore, cannot be prosecuted for crimes imposed on them without the sanction of the appropriate High Court order refusing interference in these matters, However, it was on the basis of a guarantee not to guarantee any interference, allowing the trial court to take up the aforementioned dispute, in which the final decision in the context of the relevant law. Prior to the hearing, the same decision was directed at which the Supreme Court had allowed the appeal to be allowed with such observation.
