MUHAMMAD YASIN versus STATE

Criminal Applicants on Criminal Bail in Criminal Procedure Code (CRPC) Sections 514 and 561A Panel Code (XLV of 1860), Section 381 Guaranteed Bail, Case Under Section 381, PPC I stand on bail for the accused involved. After that, when the magistrate and the accused continued to appear in court, the case was transferred to the Judicial Magistrate's Court. The accused appeared in the transfer court on certain dates of the hearing, but then escaped, which resulted in the issuance of notice to the applicant / bail, under section 141414, before the accused in the CCC applicant court. Failure to do so, the Judicial Magistrate's transfer court fined the petitioner's order. Applicants were sued, it was challenged to claim that since the applicant is a guarantor for the accused in the magistrate's court, he was only obliged to present the accused before this court and transfer the case to the judicial magistrate. If the accused was absconding then no penalty could be imposed on him. The applicant was not eligible to do so as a transfer court. According to the terms of the applicant / bail bond executed by the applicant, the applicant not only granted bail to the accused before the magistrate's court but also did not give bail before any transfer court number. Illegally, in the circumstances, the court failed to present the accused in the court on the last day of several orders to impose a fine on the applicant for the applicant.
