S.C. SUBJALLY versus A. HAMID KHAN
The Pakistan Penal Code Sections 418 and 420 Criminal Code of Conduct (V9 1898), Articles 249A & 561A, had already reached the final stage when its application went under section 249A, trial of CRPC. Court Trial Court dismissed. The defendant's request was not decided shortly after the case was filed, but the defendants also showed no interest in dealing with the same phase of the trial as soon as the defendant dismissed such request. The trial was held. It was sufficiently justified in not deciding on its merits that the petitioner was excluded under it.
